Resumé
The text presented deals with selected provisions of the law of succession in the Austrian Civil Code in the original version of 1811, namely the regulation of the compulsory part and disinheritance. These provisions are in line with the Roman inheritance law and, with the help of primary sources, it is examined how these provisions are actually inspired or taken over by Roman law. Often it was only inspired by the thought concept of Roman law, which was adjusted in detail for the needs of modern Austrian codification. Still, conclusions based on the study of numerous primary sources, as well as secondary literature, see reflection of Roman inheritance law in many aspects in Austrian inheritance law.
