Will the revision of the Schengen Borders Code solve the problems related to the reintroduction of internal border control in the EU?

Abstract

The creation of the Schengen area is one of the greatest achievements of European integration. It allows free movement within this area without border control.

However, under the rules of the Schengen Borders Code (SBC), the Member States still have the option of reintroducing border control at internal borders between them. However, there is a number of problems related to the reintroduction of internal border control.

The European Commission has recently proposed a revision of the SBC which addresses some of the problems. The aim of this paper is to identify the problems associated with the reintroduction of internal border control in practice and to answer the question whether, or to what extent, the revision of the SBC can solve them.
