Abstract

This conference presentation looks at the phenomenon of migration from the postmodernist, historical and analytical perspective. It is a known fact that the influx of refugees creates tensions within the legal system of the target states from both theoretical and applied perspectives.

This talk explores whether the principle of personality of law, forcing a level of hybridization of legal cultures is predominantly caused by the clash of cultures and to what extent language barriers play a role. As a conclusion, various possible remedies and suggestions for improving the governement politics are discussed.
