Abstract
Modern technologies for distance communication have an increasing influence on the way contracts are concluded. The use of these technologies for the conclusion of contracts was supported by European legislation (in particular by the issuance of the elDAS regulation) and significantly accelerated by the covid-19 pandemic.
It is therefore useful to know the rules for electronic contracting and the limits of this method of contracting. This is all the more true because some methods of electronic contract conclusion continue to cause interpretative and practical problems.
The purpose of the first part of this article is therefore to present the current state of legislation and the decision-making practice of the courts regarding the electronic conclusion of contracts in the Czech Republic.
