Freedom of enterprise in conflict with the reservation of conscience or religion

Abstract

This paper explores the relationship between freedom of enterprise and the reservation of religion or conscience. By analysing case law and legislation, it addresses the questions of whether corporate entities have a right to a reservation and what are its limits.

The thesis also focuses on the question of how the reservation affects employment relations, in particular the rights and obligations of employees. The thesis also provides an analysis of the Constitutional Court's ruling entitled "On the right to freedom of expression in the context of business (annexation of Crimea)".

The aim of the thesis is to provide a deeper understanding of this topic and to bring new perspectives to the issue of religious and conscientious objection in the context of freedom of enterprise.
