Abstract
Regardless of the searching for its own doctrine of European law, the Czech Constitutional Court does not have any reason to question the existing level of protection of fundamental rights, as the respective Framework Decision offers sufficient guarantees of keeping this protection. The Czech constitutional order does not justify the requirement of a special treatment of own citizens under the régime of surrender of requested persons for purposes of conducting a criminaql prosecution or execution of custodial sentence in the other EU Member State
