ESG in the context of selected competition law institutions

Abstract

Business cooperation within the ESG framework appears to be a desirable and effective way to meet ESG criteria and objectives more quickly and efficiently. However, such cooperation between businesses may attract the attention of competition authorities.

The present paper will address the question whether cooperation to achieve sustainability can be a ground for an exemption from the prohibition of agreements between Business under Article 101 TFEU. At the same time, the paper will also address the possible abuse of a dominant position by a Business that uses its dominant position to induce other Business to adopt ESG measures, thereby potentially affecting competition.
